In view of the undertaking given by the learned advocate appearing for the petitioner that the petitioner would abide by the terms so imposed by the learned Trial Court and would make himself physically available on each and every date so fixed until and unless the situation is beyond his control, I am of the view that, if the learned Trial Court finds from the record that the petitioner was earlier on bail, he may be allowed to continue on the same bail and bond provided he surrenders before the court by 20th March, 2024. If the petitioner do not surrender within the aforesaid date, on 21st March, 2024, the learned Judicial Magistrate,

Dubrajpur, Birbhum, in connection with Khoyrasole Police Station Case No. 40 of 2007, would issue harsher process of law by adhering to the provisions laid down under Section 82 Cr.P.C.

With the above observation CRR 398 of 2024 is disposed of.
