The application for contempt stood dismissed by an order dated 3rd August, 2021.
Learned advocate appearing for the petitioner submits that her client does not intend to proceed with the contempt application any further but as the application for contempt has already stood dismissed, the same cannot be withdrawn till the contempt application is restored.
I have perused the application for restoration and being satisfied with the grounds mentioned therein for non-appearance of the learned advocate for the petitioner on the day when the matter was taken up for consideration by the Court, the order dated 3rd August, 2021 stands recalled.
The contempt application is restored to its original file and number.
As the petitioner has expressed his willingness to withdraw the contempt application, accordingly, let WPCRC 160 of 2016 arising out of CPAN 2050 of 2015 stands dismissed as 'not pressed'.
The written instruction given by the petitioner to the learned advocate be taken on record.
Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
