Five writ petitions are taken up for consideration in presence of the learned advocates representing the petitioners and the respondents. On perusal of the order dated 13th September, 2023 it appears that the learned advocate representing the respondents was directed to file report by three weeks in terms of the previous order dated 5th September, 2016.

Mr. Nayak, learned advocate represents the State respondents being respondent nos. 1 & 2 and Mr. Sureka, learned advocate is representing Registrar of Cooperative Societies, being respondent no.3. Both the learned advocates representing the respondent nos. 1 to 3 are praying for further extension of time to file report.

Let such report be filed 31st January, 2024.

However, it is made clear that separate reports shall be filed by the Registrar of Cooperative Societies and on behalf of the Principal Secretary, Department of Cooperation being respondent no.1.

Advance copies of the reports shall be served upon the learned advocate representing the petitioners.

List the matters in the monthly combined

list of February, 2024 under the same heading. In Re: WPA 43 of 2015 This writ petition is considered separately in view of submission made by Mr. Sen Gupta, learned advocate representing the petitioners that the petitioner has left job under a Cooperative Society and as such petitioner is not willing to proceed with the writ petition.

However, respondent nos.1 to are represented by learned advocates.

In view of such submission made on behalf of the petitioner the writ petition stands dismissed on the ground of non-prosecution.

In view of the order passed today on this writ petition let the record of this writ petition being WPA 43 of 2015 be detagged from other matters. However, there shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
