1. Contempt application is heard in presence of the learned advocates representing applicant and alleged contemnor.

Suryaneel Das, learned Additional Government Pleader represents alleged contemnor and submits that order passed by this Court on 18th August, 2025 is complied with. It is further submitted that vide memo dated 26th February, 2026 alleged contemnor disposed of appeal. Copy of the memo dated 26th February, 2026 is placed before this Court and same is taken on record. Copy of the said memo dated 26th February, 2026 is

made over to the learned advocate representing applicant.

3. Mr.

De, learned advocate representing applicant submits that appeal was not appropriately dealt with and without serving notice to the appellant appeal was disposed of.

4. Validity and legality of the order passed by the appellate authority dated 26th February, 2026 ought not to be delved into in the contempt application. Applicant shall be at liberty to take steps in accordance with law, if so advised. Since appeal has been disposed of vide memo dated 26th February, contempt application stands disposed of and contempt proceeding stands dropped.

5. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
