1. This revisional application seeks expeditious disposal of an application under Order 7 Rule 10 of the Code of Civil Procedure, 1908 filed by the opposite party in MS 895 of 2022 pending before the learned Civil Judge (Sr. Div.), 1st Court at Alipore.

2. The learned Advocate appearing for the petitioner submits that the petitioner has instituted Money Suit no. 895 of 2022 praying for recovery of money. In the said suit, the opposite party has filed an application under Order 7 Rule 10 of the Code of Civil Procedure, 1908 seeking return of plaint. Such application was filed on September 18, 2023 but the same remains pending. It is submitted that the petitioner has already filed his written objection to the said application.

3. In view the nature of the order proposed to be passed no direction for prior service of the revisional application along with notice is being made, however, the petitioner shall remain oblige to serve a copy of the revisional

application along with this order on the opposite party within a week from date.

4. Having heard the learned advocate appearing for the petitioner and having perused the material on record this revisional application is disposed of by requesting the learned Civil Judge (Sr. Div.) 1st Court at Alipore to dispose of the application under Order 7 Rule 10 of the Code of Civil Procedure, 1908 as expeditiously as possible and preferably within a period of one month from the next date fixed without granting any unnecessary adjournment either of the parties. The learned trial Court is also requested to ensure if the pleadings in respect of the application under Order 7 Rule 10 of the Code are not completed the same may be completed expeditiously so that the application is disposed of as requested.

5. C.O. 333 of 2026 stands disposed of. There shall be no order as to costs.

6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
