Learned advocate appearing for the petitioner submits that the petitioner is in custody for 160 days. Charge sheet has already been submitted and the case being based on circumstantial evidence further detention of the petitioner is unwarranted.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the post-mortem report. It has also been submitted, supplementary charge sheet would be submitted on receipt of the FSL report.

Having regard to the nature of the allegations and primary indication in the post-mortem report, I am not inclined to release the petitioner on bail at this stage when charge has been framed and witness action is about to commence. At this stage, the prayer for bail of the petitioner in CRM (M) 302 of 2026 is rejected.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
