The petitioner has some reservations regarding the manner in which the private opposite party/applicant before the ld. Trial court is using her name. The same cannot be a subject-matter of an Execution Case filed before a court of law.

The petitioner has challenged the order dated 7.12.2021 passed by the ld. JM, First Class, 3rd Court, Tamluk in connection with Misc. Execution Case No. 267 of 2020 arising out of Misc. Case No. 317 of 2014. I find that the Misc. Execution case is pending for more than three years and the main case was filed ten years ago.

Having regard to the subject-matter and the issues so involved, I am not inclined to interfere in respect of the order under challenged.

With the aforesaid observations, CRR 374 of 2022 is dismissed.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
