Since the State Sentence Review Board, West Bengal has recommended for release of the present petitioner who was acquitted by the learned Additional Sessions Judge, 6th Court, Alipore in connection with Sessions Trial No. 1(3)1999 under Sections 302/307/34 of the Indian Penal Code and Section 3 of the Explosive Substances Act, 1908 but subsequently convicted by the Hon'ble Division Bench of this High Court in G.A. No. 3 of and has already undergone years of imprisonment, immediate steps should be taken to release the petitioner.

In view of the recommendation made by the State Sentence Review Board, petitioner will take out an application for release before the learned Additional Sessions Judge, 6th Court, Alipore and the Court would release the petitioner within 48 hours of communication of this order.

Petitioner would also be at liberty to communicate this order to the Learned Sessions Court.

Consequently, WPA 2296 of 2025 is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
