Although the petitioner is not represented at the time of call, Ms. Dhamali, learned advocate representing the Bally Municipality would submit that on the basis of the complaint lodged by the petitioner on 22nd January, 2025 alleging illegal construction, an inspection was carried out by the municipality in respect of holding No. 3, Ahmed Mamuji Street Liluah, P.S.-Belur, Howrah ward No. 26 under Bally Municipality on 24th February, 2025. 2.

On the basis of inspection, since it was found that construction that was coming up at the above plot was not in accordance with sanctioned building permit, a stop construction notice under Section 220(1) of the West Bengal Municipal Act, 1993 has already been issued. Let a copy of the aforesaid report as filed by the municipality in Court today dated 24th February, 2025 be taken on record. 3.

Having regard thereto, I am of the view that the municipality must conclude the proceedings already initiated by them in accordance with law.

It is made clear that this Court has not entered into the merits of the cause and it shall be open to the municipality to conclude proceedings being uninfluenced by any of the observations made herein.

With the above observations and directions, the writ petition is disposed of.
