Learned Advocate appearing for the petitioner submits that there is an anomaly in column 10 of the arrest memo. He submits that the so-called independent witnesses are persons who accompanied the police party while conducting the raid. He seeks bail and expeditious disposal of the trial. Learned Advocate appearing for the State submits that more than prescribed commercial quantity was seized from the petitioner. He submits that the charges are yet to be framed. Therefore, the question of direction for expeditious trial does not arise at this stage.
The issue as to whether the arrest memo was correctly drawn up or not need not be decided on this petition.
We are unable to grant bail to the petitioner as prayed for. Given the factual conspectus that changes are yet to be framed, we are unable to accede to the request of the petitioner for expeditious trial.
C.R.M. 982 of 2021 is dismissed accordingly.
