1. The present writ application has been preferred praying for cancellation of the order dated 04.07.2024 passed by the Controlling Authority, Kolkata.

The petitioner herein has been aggrieved by the said order on the ground that in spite of evidence being closed the Controlling Authority subsequently permitted the opposite party therein to adduce evidence. It is submitted that there was no order recalling the order closing evidence and in spite of that the opposite party/respondent was permitted to adduce evidence.

3. It appears from the order under revision that the opposite party/respondent herein appeared subsequently and prayed for condonation of delay with a prayer for adducing evidence.

4. The petitioner herein had filed objection thereto. It appears that the Controlling Authority rightly rejected the application praying for condonation of delay on the

ground that it was not applicable in respect of the prayer for being permitted to adduce evidence.

5. The Controlling Authority being satisfied with the explanation given by the opposite party/respondent herein permitted the opposite party/respondent herein to adduce evidence in the interest of justice which is also in accordance with law.

6. Considering the nature of relief prayed for service is dispensed with and the writ application is disposed of with the observation that the order of the Controlling Authority being a well reasoned order requires no interference by this court.

7. The writ petition is accordingly dismissed.

8. The Controlling Authority is directed to dispose of the case expeditiously.

9. Pending applications stands disposed of.

Interim order, if any, stands vacated.

Urgent Xerox certified copies of this order, if applied for, shall be supplied to the learned counsel for the parties as expeditiously as possible, in compliance of usual formalities.
