Mr. Joydeep Roy Ms. Sudeshna Das ... For the State Learned counsel for the petitioner submits that the petitioner is in custody for 1 year and 9 months. Only one witness has been examined and it will take sometime for conclusion of trial. Further detention of the petitioner is not required. Opposing the prayer for bail learned counsel for the State submits that the witnesses have disclosed the name of the petitioner as the principal assailant. Several incriminating materials have also transpired against him during trial. I have considered the material on record.

The petitioner appears to be the principal assailant who struck the fatal blow on the victim. Statement of witnesses discloses direct involvement of the petitioner in the alleged offence. Considering the material available on record as well as the gravity of offence, prayer for bail is rejected at this stage. However, in view of the period of detention of the petitioner, learned trial Court is directed to expedite the trial as far as practicable without granting any unnecessary adjournment to either of the parties, in accordance with law. The application for bail is disposed of.
