Learned counsel for the parties submit that the matter can be resolved between the parties, since the petitioner in the contempt application has agreed to pay the proportionate amount of the total quantum assessed by the WBSEDCL, relating to the petitioner's share, being Rs. 22924/-.

Upon such payment, the WBSEDCL is agreeable to give service connection at the premises-in-question. Upon hearing learned counsel for the parties, RVW 22 of 2022 along with connected applications bearing CAN 1 of 2022 and CAN 2 of 2022 as well as CPAN 37 of 2022 are disposed of by directing the WBSEDCL, as

agreed by the parties, to give electricity connection to the premises at which the petitioner sought for the same, within a week after payment of the proportionate amount due and payable by the writ petitioner, that is, Rs. 22,924/- , subject to compliance of other due formalities. However, it is made clear that nothing in this order shall prevent the WBSEDCL from realizing the balance dues in respect of giving such service connection to the premises from the other consumers of such electricity from the service line, if otherwise so entitled in law. There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
