1. Affidavit of service filed in Court today is taken on record.

2. Mr. Sujit Chatterjee, learned advocate appears on behalf of the State respondents. Let his appearance be regularized by the learned Government pleader.

3. The petitioners claim to be appointed on compassionate ground in South Bengal State Transport Corporation. They seek regularization of their service.

4. Submission is that they are serving against sanctioned vacant posts for over a decade. The service rendered by them is perennial in nature and is in the same manner as performed by regular employees.

5. A representation seeking regularization is pending consideration at the end of the respondent authority for a considerable period of time.

6. Learned advocate representing the South Bengal State Transport Corporation submits that there is no provision for regularization of service. The petitioners were appointed with an undertaking that they would not seek regularization in future.

7. Be that as it may, as the prayer of the petitioners seeking regularization is pending consideration before the authority, accordingly, no useful purpose will be served by keeping the writ petition pending.

8. The instant writ petition is disposed of by directing the Managing Director, South Bengal State Transport Corporation Ltd. being the respondent no. 4 herein to consider and dispose of the petitioners' prayer seeking regularization strictly in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order.

9. A reasoned order shall be passed and communicated to the petitioners immediately thereafter.

10. Learned advocate for the petitioners is directed to forward a copy of the subject representation along with all other supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

11. The writ petition stands dispose of.

12. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
