1. Learned advocate representing the petitioner submits in spite of effort was made to effect service upon learned advocate representing State respondents in terms of previous order service could not be effected.

2. State respondents are not represented.

3. Ms. Susmita Biswas Chowdhury, learned advocate who is present in Court and usually appears on behalf of the State respondents, is requested to enter appearance on behalf of the State respondents. Let engagement of Ms. Susmita Biswas Chowdhury be regularized by the office of the learned Government Pleader.

4. Petitioner is a retired Assistant Teacher, who superannuated on 30th June, 2016.

After superannuation of petitioner, Pension Payment Order was issued on 10th July, 2017 releasing retiral dues in favour of the petitioner. Petitioner claims interest on gratuity due to delayed payment.

5. Accordingly, the Director of Pension Provident Fund and Group Insurance and the concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to the petitioner on gratuity from the date following the date of retirement of the petitioner till the date of release of gratuity, within a period of eight weeks from the date of communication of this order.

6. Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

7. With the above observation, the writ petition stands disposed of.

8. There shall be no order as to costs.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
