The Advocate-on-Record of the petitioner undertakes to affirm and stamp the petition/application as per the Rules within four weeks from date. Subject to such undertaking the application is taken up for hearing.

This is an application for bail in connection with Farakka Police Station Case No. 167 of 2019 under Sections 302/34 of the Indian Penal Code at the behest of the petitioner.

Learned Advocate for the petitioner submits that although the petitioner is in custody for more than 600 days yet there has been no progress of the case and the petitioner is unnecessarily languishing in jail.

Learned Advocate for the State opposes the prayer for bail and submits that the petitioner is deeply connected with the alleged offence and the present case would not be expedited/committed before the court of sessions because another accused person is absconding.

We have perused the case diary, materials on record and we are of the opinion that this is not a fit case where the petitioner should be released on bail at this stage.

Accordingly, the application for bail being CRM 994 of 2021 is rejected.

However, the learned Additional Chief Judicial Magistrate, Murshidabad at Jangipur, is requested to comply with the order dated 3rd March 2020 at the earliest after compliance of all formalities.
