Ms. Manjuli Chowdhury, Ms. Mekhla Sinha ... for Howrah Zilla Parishad The grievance of the petitioners is that Howrah Zilla Parishad has sanctioned a building plan in favour of the private respondent in L.R. Dag Nos. 1773, 1775, 1776, J.L. No. 55 Mouza Bankra, Gram Panchayet Bankra - I, Police Station Domjur.

It is the specific case of the petitioners that the land where the building plan has been sanctioned is the private land of the petitioners. Howrah Zilla Parishad could not have sanctioned the building plan in favour of the private respondent in respect of the aforesaid land.

I am afraid that the Writ Court cannot decide the issue of title in respect of the land in question. Accordingly, the writ petition WPA 2621 of 2021 stands dismissed.

However, it will be open for the petitioners to approach the appropriate forum for declaration of title in

respect of the aforesaid land in question, in accordance with law, if so advised.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
