The petitioner prays for transfer of the said suit to any court at Barrackpore as the court of the learned Additional District Judge, Fast Track 4th Court is lying vacant. The suit is running ex parte. The petitioner has been waiting for the disposal of the suit.

Under such circumstances, this court directs the learned District Judge, North 24 Parganas to transfer the suit to any other functioning court of competent jurisdiction. The learned transferee judge, upon receipt of records, shall issue notices to all the parties and proceed with the adjudication.

The application is disposed of.

All the parties are directed to act on the basis of the server copy of the order.
