1. Appellant is represented by the learned Advocate.

3. In pursuance of the direction passed by this Court a report is submitted by the Inspector-in-Charge of Uluberia P.S. Howrah Rural Division which indicates that during pendency of this appeal the sole appellant/convict Santimoy Gangopadhyay @ Ganguly has been expired on 19.12.2023. A photocopy of certificate of death of the said convict/appellant is collected and tagged with the report which also affirms the death of the appellant/convict.

4. As the sole appellant has been expired during pendency of this appeal, the present appeal stands abated against him.

5. Accordingly, the instant appeal being CRA 43 of 1991 is hereby dismissed as abated.

6. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court immediately.

7. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
