The writ petitioner/secured creditor seeks enforcement of the order passed by the District Magistrate under Section 14 of the SARFAESI Act, 2002. The secured asset is a residential flat no. 3B, situated on the 3rd Floor of Tower-5 at Ekta Floral, Christopher Road, P.S.-Tangra, Kolkata-46.

Tangra Police Station has submitted a report indicating that a writ petition being WPA 22884 of 2022 has been filed by one Minu Harbhajanka, wife of Rakesh Harbhajanka. The bank confirms the same. The petition has neither been moved or listed till date. The parties are not aware of any interference with the orders passed by the DM.

In that view of the matter, Tangra Police Station shall hand over physical possession of the secured assets on 23rd February, 2023 at 2.00 p.m.

The bank confirms that all costs for deployment of police force have been paid to the Tangra Police Station.

Notice of this order shall be served to the advocate on record for the petitioner in WPA 22884 of 2022.

The writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
