This is an application for bail in connection with Gaighata Police Station Case No. 424 of 2020 under Section 302 of the Indian Penal Code at the behest of the petitioner. This is a renewal for bail after the rejection of the earlier bail application filed by the petitioner on 14th December 2020.

It appears in course of hearing that three witnesses have already been examined after the earlier order of rejection and, according to the State, five witnesses are yet to be examined.

In view of the alleged complicity of the petitioner to the offence allegedly committed and that substantial progress has been shown in the trial of the case after the rejection of the first application for bail, we do not think that it is a fit case where the petitioner should be released on bail at this stage.

Accordingly, the application for bail being CRM 999 of 2021 is rejected.

However, the prosecution is requested to produce the witness on the next date so fixed and the learned Judge

would make endeavour to complete the trial within eight months from the date of communication of this order. (Harish Tandon, J.) (Tirthankar Ghosh, J.)
