Mr. Animesh Mukherjee Ms. Banani Bhattacharjee ...for Union of India The petitioner was allotted a seat in the Stray Vacancy Round of counseling for the NEET UG Exam, 2024. However, the petitioner was not permitted to participate in the NEET UG Exam, 2025, based on notifications dated November 19, 2024, and November 22, 2024, issued by the Union and the State, respectively.

These notifications prohibited participation in subsequent examinations for any student who had been allotted a seat in the Stray Vacancy Round of counseling in the preceding year. Nonetheless, the petitioner has been allowed to participate in the NEET UG Exam, 2025, irrespective of the allotment of a seat in the Stray Vacancy Round of counseling for the NEET UG Exam, 2024.

The learned advocate representing respondent no. 2, along with the learned advocate for added respondent no. 5, jointly submit that the petitioner's

result will be published following his participation in the examination.

Nothing further remains to be decided in this writ petition. It is hereby clarified that the petitioner will be eligible to participate in the counseling process based on his rank in the examination.

Accordingly, WPA 2495 of 2025 is disposed of. Urgent certified website copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
