C.R.M. 524 of 2018 (AD) 26.04.2023 Court No.29 (Dismissed) In Re: - An application under Section 439(2) of the Code of Criminal Procedure, 1973.

And In the matter of: - Champa Patra ...petitioner.

Md. Younush Mondal ... for the petitioner.

Mr. Saibal Bapuli, Ld. APP Mr. Arani Bhattacharyya ... for the State.

In assailment is the order dated November 10, 2017 passed by the learned Sessions Judge granting anticipatory bail to the private opposite party.

While granting such anticipatory bail, learned Judge took into consideration the materials in the case diary, the fact that two coaccuseds were granted bail by the jurisdictional Magistrate and the injury report of the victim. Learned Judge while granting anticipatory bail also found that there was no need for custodial interrogation of the private opposite party.

We find no material irregularity in such order warranting cancellation of the anticipatory bail granted. Moreover, the application is pending since 2018.

C.R.M. 524 of 2018 is dismissed accordingly.
