Mr. Rameshwar Sinha Ms. Amisha Sengupta ...for the petitioners Mr. Joydip Banerjee Mr. Rajaram Banerjee ...for the State In substance, the petitioners seek the implementation of an order passed by a Co-ordinate Bench of this Court on May 15, 2025, in WPA 4239 of 2025. By the said order, the learned Judge directed the respondents to consider the grievance of the petitioners concerning an alleged unauthorized construction undertaken at the instance of respondent no. 7.

Learned counsel appearing for the petitioners submits that, notwithstanding the order, no action has been taken by the concerned Panchayat.

While there is no bar to maintain a writ petition for the purpose of executing an order passed in an earlier writ petition, this does not imply that a Coordinate Bench will invariably act as an Executing Court for the orders of another Co-ordinate Bench of this Court. The petitioners have an alternative remedy

available to secure implementation of the order dated May 15, 2025.

In view of the availability of such alternative remedy, this Court is not inclined to entertain the present writ petition.

Accordingly, WPA 2562 of 2026 is dismissed.

This order shall not preclude the petitioners from taking appropriate steps by filing a suitable application for enforcement of the earlier order. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
