Mr. Pinaki Dhole, counsel appearing on behalf of the State submits that he has received instruction from the Director of Mass Education Extension that the papers in relation to the retiral benefits of the petitioner are ready and shall be sent to the Director of Pension, Provident Fund and Group Insurance within a period of ten days. He further submits that provident fund has already been released in favour of the petitioner and credited into the bank account of the petitioner.

In light of the above submission, this writ petition is disposed of with a direction upon the respondent nos.3, 4 and 5 to ensure that the papers of the retiral benefits in relation to the petitioner are sent to the Director of Pension, Provident Fund and Group Insurance, being the respondent no.7 within a period of ten days from date and upon receipt of the same, the respondent no.7 is directed to ensure that

the Pension Payment Order is issued in favour of the petitioner within a period of eight weeks from the date of receipt of the documents from the respondent nos.3, 4 and 5 in accordance with law.

Since, no affidavit-in-opposition has been called for the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
