Kausik CRM (NDPS) 213 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Rejinagar Police Station Case No. 150 of 2025 dated 26th May, 2025 under section 20(b)(ii)(C)/29 of the NDPS Act, 1985. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 8 months and the subject matter of the case relates to recovery of 99 Kgs. of Ganja from the roof of a bus. Petitioner was arrested pursuant to statement of the conductor and the driver of the said bus. Date has been fixed for consideration of charges. So far as the materials which are appearing in the case diary, according to the learned advocate for the State, it is the statement of the driver and the conductor.

Having considered the same, I am of the view that the petitioner be released on bail after the stage of consideration of charges are over.

Learned Trial Court would impose such terms and conditions as he deems fit and proper for ensuring the appearance of the present petitioner before the Trial Court pursuant to release on bail.

With the aforesaid directions CRM (NDPS) 213 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
