Learned advocate appearing for the petitioner submits that, the petitioner was an employee of a firm. Police complaint was lodged subsequent to the petitioner leaving such employment. The petitioner also lodged a police complaint. He refers to the contents of the complaint in the present police case and submits that, the defacto-complainant acknowledged that the petitioner was to make over a cheque of Rs.5 lakhs and the title deeds relating to the public property.

Learned advocate appearing for the State draws the attention to the materials in the case diary. We find from the materials in the case diary that a sum in excess of Rs.41.23 lakhs came out of the account of the firm into the account of the petitioner while the petitioner was in the employment with the firm. Such fund was not utilized for the firms.

We also find from the case diary that there is a writing signed by the petitioner acknowledging his liability to the firm to such extent.

Given the materials in the case diary, the nature of offence alleged as against the petitioner and the complicity of the petitioner therein, we are unable to grant anticipatory bail to the petitioner and the prayer for anticipatory bail of the petitioner is rejected.
