Learned advocate appearing for the petitioner submits that pursuant to the earlier direction passed on 03.12.2025 charges have already been framed by the learned Trial Court. The principal accused being Nirup Sarkar has already been granted bail.
Learned advocate for the State opposes the prayer for bail and submits that the present petitioner is an owner of the vehicle from where recovery has been made and there are call data records which would reveal the connection between the other accused and the present petitioner. Petitioner is also having antecedents.
Having considered the quantum of recovery and so far as the present case is concerned, the other accused person being on bail, I am of the view that having considered the petitioner being in custody for 7 months and the charge being framed, further detention of the petitioner is unwarranted. Accordingly, Petitioner, namely, Narayan Biswas @ Bisu @ Raj shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court under NDPS Act cum Learned Additional Sessions Judge, 3rd Court, Dakshin Dinajpur, Balurghat.
If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 214 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
