The petitioner claims to be the Secretary of a registered club in village Pakurtala, District- South 24Parganas. The instant writ petition has been filed as a Public Interest Litigation ventilating the alleged grievance that in spite of repeated requests and representations made by the petitioner on behalf of the residents of the said village to the administration, for setting up a public library in the village, the same has not been done. The petitioner also requests for a onetime grant from the Government of West Bengal for the purpose of setting up of a library.
Accommodation was sought for on behalf of the petitioner. However, having perused the papers on record, we deem it appropriate to dispose of the application by passing an order which, in our view, will not prejudice anybody.
It appears that several representations have been
made to the District Magistrate, South 24-Parganas by the petitioner. We direct the District Magistrate being the 3rd respondent to consider the representations of the petitioner in accordance with law and dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioner or his authorized representative, within a period of eight weeks from the date of communication of this order to the 3rd respondent by the petitioner. We hope that the District Magistrate will take an informed decision keeping in view the fact that right to education and right to information in general is now recognized as an important constitutional right. It is expected that if the 3rd respondent, District Magistrate finds the requests of the petitioner to be reasonable and capable of being acceded to, appropriate action will be taken by the 3rd respondent, District Magistrate as he may deem fit and proper.
Since no affidavits have been called for, the allegations made in the writ petition are deemed not to be admitted by the respondents.
WPA 1449 of 2020 is accordingly disposed of.
