The petitioner says that he has been falsely implicated. Although he is the owner of the truck from which seizure of commercial quantity of contraband items was made, he has no role to play in the alleged offence. He had hired out his vehicle to a third party who was operating the same. He is in custody for 98 days. He prays for bail.

Opposing the bail prayer, learned State Advocate says that 501 kgs of ganja was recovered from the truck in question. Undisputedly, the petitioner is the owner of the truck. It is inconceivable that the petitioner was not aware that his truck was being used for illegal purpose.

At this stage, we are in agreement with learned Advocate for the State. 501 kgs of ganja is a huge quantity. In view of the restrictions in Section 37 of the NDPS Act, we are not inclined to enlarge the petitioner on bail, at this stage.

CRM (NDPS) 166 of 2025 is, thus, dismissed.
