23.09.2021 Sl. No. 2 Court No.29 S.A.

CRR 176 of 2010 In the matter of: Sk. Abdul Salim ...petitioner Mr. Rana Mukherjee, Ld. A.P.P.

Mr. Pravas Bhattacharya ... ... for the State The matter is fixed up today for hearing after filing of affidavit of service upon the opposite parties by the petitioner. On call none appears for the petitioner/revisionist. State is represented through Mr. Rana Mukherjee, ld. A.P.P. along with Mr. P. Bhattacharya, ld. Advocate. Concerned authority is requested to regularise their appointment.

The previous order has not been complied by the petitioner. This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner - being aggrieved with order dated 25.03.2009 passed in Sessions Trial No.9 of 2006 by the Additional District & Sessions Judge, Fast Track 4th Court, Paschim Medinipur. By the impugned order dated 25.03.2009, learned Judge, Fast Track Court had simply ordered a copy of the application filed by the de facto complainant to be kept with the record and to be put up before the regular P.O. when he joins.

Being aggrieved and dissatisfied with such impugned order, the petitioner has come before the court for setting aside the order of the Fast Track Court where nothing had been decided.

Heard learned prosecutor present in the Court. It appears from the certified copy of the order placed before this Court in connection with Sessions Trial No.9 of 2006, that several orders were passed in the case thereafter. Since the order challenged is interlocutory in nature, without deciding anything in favour of the petitioner, I find there is no illegality or impropriety in the order. The said order was passed by the learned Judge remaining incharge of another court before whom the file was put up. In my considered view, this application for revision is not maintainable. The same is accordingly dismissed. Let a copy of this order be sent to the court of Fast Track Court at Paschim Medinipur for information.
