Mr. Pravas Bhattacharya ... ... for the State The criminal revision is listed today for hearing. In the previous order, the petitioner was directed to serve a copy of the revisional application upon the opposite parties . On call none appears for the petitioner nor for the opposite party members.

On perusal of the application it appears that the petitioner prayed for setting aside the order dated 21.10.2009 passed by the learned Judicial Magistrate, 2nd Court, Siliguri in M.R. Case No.16 of 2009 wherein interim maintenance was allowed to the petitioner/wife and minor child. There was a direction by this Court for payment of the interim maintenance at the rate of Rs.1000/- per month for the wife and Rs. 1500/- per month for the minor child. The revisionist has not turned up before this Court to report whether the order has been complied or not.

Considering the materials in the record and the impugned order, I find no illegality therein. Learned Magistrate had also been directed to expedite the final hearing of the case.

In such circumstances, the Criminal Revision is without merit and the same is dismissed.

Let a copy of this order be sent to the learned Judicial Magistrate, 2nd Court, Siliguri for information. (Ananda Kumar Mukherjee, J.)
