Kausik (Rejected) CRM (NDPS) 215 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1255/2024 dated 13.08.2024 under Sections 21(c)/25/27A/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 5 months and the subject matter of the case relates to alleged recovery of 1.694 Kgs. of Brown Sugar.

It has also been submitted that similarly placed accused person has already been granted bail. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that the other accused persons have been granted statutory bail.

I have taken into account the overall circumstances, the period of detention and its cause. It reflects that since one of

the accused person was absconding there has been delay in the process.

In view of the aforesaid I direct the learned Trial Court to split up the case at the earliest and thereafter proceed towards consideration of charges of the case. Having considered that commercial quantity of contraband being involved, I am not inclined to release the petitioner on bail.

Accordingly, CRM (NDPS) 215 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
