The petitioner who is the widow of Jalaluddin Shaikh, since deceased, who completed work in terms of three work orders issued by the Karimpur I Gram Panchayat seeks disbursal of the bills raised by the contractor upon satisfactory completion of the work. It appears from the report submitted by the Panchayat that on inspection of the work done in connection with the three work orders the work in respect of the first and second work orders was found to have been completed. However, the work in terms of the third work order was not seen to have been done. The Pradhan, Karimpur I Gram Panchayat submits that the amount of Rs. 2,33,223/- due in respect of the first order can be cleared immediately, but the amount of Rs. 2,68,993/- in connection with the second work order cannot be disbursed now due to paucity of fund under the relevant head.

Since the work was completed in 2020 and such work in terms of 1st and 2nd work orders appears to have been completed satisfactorily, the Pradhan, Karimpur I Gram Panchayat, being the 6th respondent herein, is directed to disburse the amount of Rs.2,33,223/- in respect of the first work order to the petitioner within 7 days from date subject to the petitioner complying with all requisite formalities. The other amount of Rs. 2,68,993/- shall be disbursed by the said respondent to the petitioner within 8 weeks from the date of communication of this order. The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
