Learned Counsel for the petitioner has submitted that the instant revisional application has been filed on January 15, 2018. However, subsequently charge sheet has been filed and the present petitioner Mr. Akash Sarkar @ Raju son of Asraf Sarkar has been shown as not charge sheeted.
Learned Counsel for the State has also submitted that the instant case has become infructuous as the petitioner Akash Sarkar was not sent up for trial.
I have gone through the materials on record including the copy of the charge sheet wherefrom it appears that the petitioner has not been sent up for trial and as such there is no need for passing any order on the basis of the prayer made in the instant revisional application. As per the provisions of law, Akash Sarkar being not sent up for trial is entitled to discharge from the relevant criminal proceeding.
With the aforesaid observations, CRR No. 174 of 2018 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this court. ( Apurba Sinha Ray, J. )
