1. Learned advocates appearing on behalf of the petitioner and the bank submits that the facts of this case are similar to the facts of the case being WPA 28239 of 2023 (Hemant Kanoria -Vs- Bank of India) decided by the Court vide judgment dated 2nd February, 2024.

2. As it has been admitted that the facts of the earlier writ petition and the present one are the same, the judgment delivered by the Court on 2nd February, 2024 shall be made applicable in the instant case.

3. The operative portion of the judgment dated 2nd February, 2024 starting from paragraph 74 onwards shall be made applicable in this case.

4. The writ petition stands disposed of.

5. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
