In the matter of : Suchismita Chakraborty. ... Petitioner. Ms. Aiswarjya Gupta.
.....for the Petitioner.
Ms. Zareen N. Khan, Mr. Ashok Das.
.....for the State.
Petitioner seeks anticipatory bail in connection with Tehatta P.S. Case No.436 of 2020 dated 05.10.2020 under Sections 498A/323/307/34 of the Indian Penal Code. Learned Advocate appearing for the petitioner submits that she is the mother of the sister-in-law of the de-facto complainant. The petitioner is not connected with the alleged offence.
State is represented.
We have perused the Case Diary. We do not find any incriminating material in the Case Diary as of now as against the petitioner so as not to grant anticipatory bail. We are also informed that the charge sheet in respect of the criminal case was submitted.
Hence, the prayer for anticipatory bail is allowed. Accordingly, we direct that in the event of arrest the petitioner shall be released on anticipatory bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and
subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall appear before the Court below and pray for regular bail within four weeks from date. This application for anticipatory bail is, thus, allowed. The application for anticipatory bail, being CRM 1020 of 2021, is thus disposed of.
