Banerjee) Ms. Soni Ojha ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Judge, 10th Bench, City Civil Court at Calcutta to dispose of Title Suit No. 400 of 2019 expeditiously.

Learned advocate appearing for the petitioner submits that the opposite party is delaying the hearing of the title suit which is a suit for partition. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.

From the order-sheets appended to this revisional application this court finds that April 10, 2025 was fixed for evidence of the defendant's witness.

Learned advocate appearing for the petitioner submits that the next date for evidence of the defendant's witness has been fixed on July 9, 2025. In the light of the submission made by the learned advocate appearing for the petitioner CO 342 of 2025 stands disposed of by requesting the learned Judge, 10th Bench, City Civil Court at Calcutta to make an endeavour to see that Title Suit No. 400 of 2019 is disposed of as expeditiously as possible, preferably within a period of six months from the next date fixed.

This order has been passed considering the fact that suit is at the evidence stage and pending since 2019.
