Firoz Alam v. State Of West Bengal & ORS
06.09.2021 jb.
W.P.A. 1504 of 2020 (Firoz Alam vs. State of West Bengal & Ors.) Mr. Debasish Saha Md. Moniruzuman Mr. Dipak Basu .... For the Petitioner Mr. Santanu Mitra Mr. Sudip Sarkar .... For the State The grievance of the petitioner is that he applied for a short term mining lease for extracting sand before the respondent authority on 27th December, 2019. The respondent sought some clarifications of discrepancies in the said application by letter dated 4th February, 2020 and reply to the said letter was sent to the respondent on 17th February, 2020. The petitioner submits that despite complying with the directions of the concerned authority his application dated 27th December, 2019 has not been disposed of till date. Learned counsel for respondents produces a copy of the order dated 18th March, 2020 and submits that the application filed by the petitioner was considered and rejected on the said date.
According to the petitioner, the said order was not communicated to him.
Having considered the submissions made on behalf of the parties as well as prayers of the petitioner I am inclined to hold that as the application of the petitioner has already been disposed of by the respondent, the writ petition has become infrucutous and is accordingly disposed of.
However, the respondents are requested to serve a copy of the order dated 18th March, 2020 upon the petitioner at the earliest.
W.P.A. 1504 of 2020 is accordingly disposed of. As no affidavit has been called for, allegations contained in the writ petition are deemed not to have been admitted.
Urgent certified website copy of this order, if applied for, be given to the parties on compliance of requisite formalities.
