Despite service, none appears on behalf of the Staterespondents. Affidavit-of-service is taken on record. The petitioner submits that as a complaint had been lodged against the respondent Nos.6 to 20, the said respondents, out of vengeance have been threatening the petitioner. It is alleged that after some of the respondents were released on bail, they tried to contact the petitioner over voice message and via Bluetooth. The petitioner was threatened with dire consequences. The petitioner was asked to withdraw the complaint. The petitioner apprehends that some harm may be caused to the petitioner, if the petitioner did not withdraw the complaint.

The entire allegation is with regard to intimidation and threats that were received by the petitioner after

registration of English Bazar Police Station Case No.200 of 2019 corresponding to GR No.811/2019 under Sections 348/323/506/34 of the Indian Penal Code.

Learned Advocate for the respondent Nos.6 to 9, 13, 15, 16 and 19, submits that the allegations are baseless, false and frivolous. That the police authorities are investigating. That pursuant to the complaint lodged by the petitioner, the police authorities have already submitted a prosecution under Sections 107/116(3) of the Code of Criminal Procedure. Under such circumstances, after having heard the learned Advocates for the respective parties, this Court is of the view that the respondent No.5, that is, the Officer-inCharge, English Bazar Police Station, must ensure that the parties maintain peace and tranquility and do not enter into any further altercation over the issues, which are still under investigation.

The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
