The Report dated 04.09.2023 received from the Inspector-in-Charge of Kotwali Police Station, KPD, Nadia states that appellant i.e. Purnendu Mukhopadhyay has expired on 14.09.2018 and the respondent i.e. Binapani Chandra Chowdhury has expired on 12.05.2002 supported by the death certificate of both the parties. The said report along with death certificates be kept on record. No steps have been taken by either of the parties to substitute the legal heirs.

Under the facts and circumstances, the instant appeal stands abated and disposed of accordingly. Copy of the order sent to the trial court for due compliance.
