Apprehending arrest in connection with Hare Street Police Station Case No.
of under Sections 409/420/406/506/504/120B of the Indian Penal Code, the petitioners have filed the instant application for anticipatory bail under Section 438 of the Code of Criminal Procedure. Pursuant to the order dated 20th July 2021, the report is filed by the learned Advocate for the State. It is revealed in the said report that pursuant to the information given to the petitioners to appear before the Investigating Officer, they complied the requisition made therein and handed over all the relevant documents pertaining to the transaction between the defacto complainant and the petitioners. The aforesaid documents have been seized and kept in the custody of
the Investigating Officer.
Since the allegation pertains to the recovery of time barred amount of money and the petitioners have complied the requisition made by the Investigating Officer, we do not find any justification in custodial interrogation of the petitioners. The prayer for anticipatory bail is thus allowed.
Accordingly, in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer of the concerned police station and on conditions as laid down under Section 438(2) of the Code of Criminal Procedure and on further condition that the petitioners shall meet the Investigating Officer as and when called for. The application for anticipatory bail, being CRM 1027 of 2021 is thus disposed of.
