Nafisa Kamal Sultana v. State Of West Bengal

2026-02-16Hon'Ble Justice Jay Sengupta2 pages

AD 59 February 16, 2026 Ct. 28 SG CRM(A) 404 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Nabagram P.S. Case No.502 of 2025 dated 12.08.2025 under Sections 420/467/468/471/34 of the IPC. And In the matter of: Nafisa Kamal Sultana ... petitioner Mr. Tapodip Gupta Mr. Suman Bhanja Mr. Golam Ahammed ... for the petitioner Ms. Faria Hossain Mr. Shiladitya Banerjee ... for the State Learned counsel for the petitioner submits that the petitioner is a housewife. She has been falsely implicated in this case. The allegation is that although the petitioner sold some land to the de facto complainant, she failed to give possession of the same.

Learned counsel for the State strongly opposes the prayer for anticipatory bail, relies on the statements of witnesses and the copies of deed and submits that the petitioner had sold some land to the de facto complainant which actually did not belong to her. The petitioner had forged the mother deed to show that she had purchased the property from a subsequent owner.

Considering the above, the other incriminating materials available in the case diary and the alleged role ascribed to

the present petitioner, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
