The petitioners are aggrieved by an order dated July 29, 2024, passed by the learned Judge, 2nd Court, City Civil Court at Calcutta in Title Suit No.1228 of 2019. The learned court rejected a joint petition of compromise filed in respect of Title Suit No. 1228 of 2019, inter alia, holding that by an earlier order the High Court had directed that Title Suit No.1228 of 2019 must be heard analogously with Title Suit No.1415 of 2008.

Nothing prevents the parties from compromising the suit. Accordingly, the joint petition of compromise shall be accepted by the learned trial judge and the Title Suit No.1228 of 2019 shall be disposed of, recording such compromise.

It is submitted by the parties that the suits were at the interlocutory stage. Trial had not commenced. Thus,

Title Suit No.1415 of 2008 shall be proceeded with independently from the stage it had reached.

The learned court is directed to pass necessary orders on the basis of this direction expeditiously. Parties are at liberty to pray for an urgent listing of the matter by filing a joint put up petition, for compliance of this order.

Accordingly, the revisional application is disposed of. All the parties are directed to act on the basis of the server copy of this order.
