02.05.2022 Court No.13 Item No.23 AP WPA 2121 of 2022 Golam Haydar Vs.

The State of West Bengal and Ors.

Mr. Tanmoy Sett Mr. Sourov Mondal ... For the Petitioner.

Ms. Jayeeta Sinha Mr. Sandip Mondal ... For the State.

Counsel for the State submits a report before this Court issued by the Officer-in-Charge, Salar Police Station, dated 26th April 2022 and the same is taken on record.

It appears from the said report that one Goutam Sarkar, SI of the Salar Police Station, has strictly complied with the Civil Court's order and a further report in that regard has already been submitted to the learned Civil Court.

Counsel for the petitioner, however, submits that the private respondents are still continuing to violate the Civil Court' order of status quo. In that view of the matter, the petitioner may bring the notice of violation of the Civil Court's order to the said Court by way of a formal application. The Civil Court shall dispose of the said application in accordance with law, as it may deem fit.

Needless to mention that the Salar Police Station shall continue to comply with any order that may be passed by the Civil Court.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
