(VIA VIDEO CONFERENCE) Mr. Anirban Majumder Mr. Azmat Ara ...for the petitioner Mr. Soumitra Bandyopadhyay Mr. Subhasis Bandopadhyay ...for the State The grievance of the petitioner is directed against the refusal by the respondent authorities to grant a contract of carriage (Auto-Rickshaw) permit in respect of route Kalaberia to Chandipur.

Mr. Soumitra Bandyopadhyay, Advocate appearing on behalf of the State-respondents submits that he has no objection if the petitioner makes an application in accordance with law to the Appropriate Authority being the respondent no. 2 for the aforesaid Auto-Rickshaw permit. In view of the submission made by Mr.

Bandyopadhyay, WPA No. 1526 of 2020 is disposed of by granting liberty to the petitioner to make an appropriate application in accordance with law to the respondent no. 2 within a period of two weeks from date for the aforesaid contract of carriage (Auto-Rickshaw) permit. If such an application is made by the petitioner to the respondent no. 2 within the stipulated time period the respondent no. 2 will consider and dispose of the same in accordance with

law without being influenced by any observation made in this order on the merits of this case within four weeks from date of filing of such application.

It is made clear that I have not entered into the merits of this case and the respondent no 2 will not be influenced by any observation on the merits of this case. All questions are to be decided by the respondent no 2 in accordance with law.

It is also made clear that after disposing of the representation of the petitioner the respondent no 2 will communicate the result of the consideration to the petitioner.

With the above observations and directions, this writ petition being WPA No. 1526 of 2020 stands disposed of. There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
