The report reflects that out of the nine witnesses so cited by the prosecution, two witnesses have already been examined and the next schedule has been fixed on and from 19th of April, 2024.

Having considered the manner in which the date has been fixed by the ld. Trial court, I am of the view that the same is done smoothly but the availability of the witnesses are to be ensured.

Accordingly, the officer in charge of Bhutni P.S. will act as a Nodal Officer so that the rest of the witnesses, who are to be examined, are available on the date so fixed.

The ld. Trial court will give a direction upon the ld. Public Prosecutor conducting the case to cooperate with the officer in charge of concerned P.S.

Let the schedule, as usual, be fixed once in every 60 days which would consist of three dates. The ld. Trial court would fix such dates after the ld. Public Prosecutor ensures the court regarding the availability of the witnesses concerned.

Ld. Public Prosecutor conducting the case would produce all the materials, exhibits and documents on the date so fixed for examination of the witnesses concerned. No unnecessary adjournment be granted to any of the parties. The trial of the case should continue in spite of any resolution of the local bar and the conducting advocates will not stall the proceedings on any ground whatsoever. All stakeholders will cooperate with the ld. Trial court to take the trial to its logical conclusion at the earliest. With the aforesaid observations, CRR 414 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
