Advocate for the petitioners submits that they were earlier on bail but because of the miscommunication they could not appear and, as such, subsequently, warrant of arrest has been issued against them.

A report was called for and, accordingly, Mr. Datta, ld. Advocate for the State, has submitted a report, which reflects that the execution report of warrant of arrest is fixed on 24th of May, 2024 before the ld. ADJ, Fast Track, 4th Court, Barasat, North 24 Parganas.

In view of the aforesaid, I direct that in case the present petitioners namely, Sahadeb Mistri, Sudhir Mistri, Sabita Mistri, Shankar Mistri and Sanjay Mistri, appear and surrender before the ld. ADJ, Fast Track, 4th Court, Barasat by 20th of April, 2024 in connection with Sessions Trial No. 1(1)/2020 arising out of Ashokenagar P.S. Case No. 674 of 2013 and the ld. Trial Court on inspection of the records is

of the opinion that the petitioners were earlier on bail, would allow the petitioners to continue on the same bail and bond, subject to condition that for a period of next six months they shall meet with any police officer deputed by the inspector in charge of Ashokenagar P.S. once in a week.

In case, the petitioners do not surrender by 20th of April, 2024, the ld. Trial court would proceed on 21st of April, 2024 for steps adhering to section 82 of the cr.p.c. With the aforesaid observations, CRR 412 of 2024 is disposed of.

Pending application, is any, is also disposed of. Report so submitted be kept with the record.
