The petitioner is aggrieved by the manner of progress of evidence in connection with Misc. Case No. 169 of 2020 under Section 125 of the Code of Criminal Procedure pending before the learned Judicial Magistrate, 3rd Court, Tamluk, Purba Medinipur.

Having considered the main grievance of the petitioner that the applicant is continuously seeking time before the learned trial court, I direct the learned trial court to see that the evidence is conducted on the date so fixed. The learned trial court while considering the same will take into account obviously the dues or the arrears which have accrued and the right of the husband also to have a free and fair trial and opportunity which includes within its ambit that the trial must be concluded within a reasonable period of time. On and from the next date, at least one date in a month must be fixed for the purposes of the case so that the learned trial court is able to understand the difficulties of the applicant/wife in concluding her evidence.

All efforts be taken to conclude the trial by 30.06.2024. With the aforesaid observations, the revisional application being CRR 326 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
