Petitioner Mr. Arup Kumar Bhowmick ...for the petitioner Mr. Partha Pratim Das Ms. Sukteya Ganguly ..for the State Learned counsel appearing on behalf of the petitioner submits that the only material available against the present petitioner is the statement of the co-accused which is not admissible in evidence. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that other than the materials available in the case diary, there are as many as 11 criminal antecedents against the present petitioner, some pending under the provisions of the NDPS Act.

Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider that this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
